In her ruling relating to a hearing on 10 August, New York Supreme Court Justice Shirley Kornreich highlights “…the unsportsmanlike behavior of Golden Gate that has resulted in substantially reducing SNG’s (Société Nautique de Genève) advantage as originally contemplated by the Deed of Gift.”
The 33rd America’s Cup Defender, Société Nautique de Genève, had filed an Order to Show Cause in front of Justice Kornreich who, despite such an unprecedented statement describing the actions of GGYC, considers such “actions are not contrary to law” and is left with no option but to deny the motion.
Justice Kornreich’s order also reiterates that the race shall be sailed under the rules and sailing regulations of the SNG.
SNG and its representing team Alinghi remain committed to a 33rd America’s Cup fought on the water in Ras al-Khaimah in February 2010.

Is the first report issued by the Golden Gate Yacht Club. BMW Oracle has announced that it intends to negotiate a protocol with Alinghi for the 33rd edition of the Copa America’s involvement in allowing the competition to other teams interested, as announced by the U.S. team in a statement.
This is the first report issued by the Golden Gate Yacht Club, sailing club which competes for the BMW Oracle, after the ruling issued in New York, which meant the team as “Challger of the record and opened the possibility of This was an America’s Cup duel with three races with the exclusive participation of BMW Oracle and Alinghi defender.
In the U.S. release of the club says that this possibility “follows the decision last Thursday by the Supreme Court of the State of New York, which decided that Oracle was the ‘Challenger of Record.”
“The owner of BMW Oracle, Larry Ellison, and the president of Alinghi, Ernesto Bertarelli, has been in communication between them since the court’s decision in New York,” added the text.
“At this time, the Golden Gate Yacht Club cree that it is best to maintain communication between the parties, to achieve successful conclusions as soon as possible,” the note of the yacht club.

Club Náutico Español de Vela (CNEVA) the Spanish Challenge has received the decision of the Court of Appeal of the Supreme Court of New York on the America’s Cup with “disappointment” as indicated in a statement.

A total of nineteen teams have registered for disputing 33rd edition of the America’s Cup to be held in Valencia, eight more than in the previous one, according Today communicated AC Management, organizer of the competition.
All the teams that participated in the 32nd America’s Cup, also disputed waters in Valencia, have re-enrolled for the next edition, except the U.S. BMW Oracle, which maintains a legal conflict with the organization.
In addition to the Ombudsman, and Alinghi, and the Challenger of Record, Desafio Espanol, a total of 21 teams submitted an application for registration and 17 have been accepted, although three of them are outstanding teams registered some minor details in its registration process Officer and were granted an extension until Jan. 15.
A three other teams have not been allowed to register because it has not received any further documentation that the application for registration beyond December 15, the registration deadline, while the Carbon Challenge has been withdrawn.
The teams have worked together in recent months in frequent meetings of competitors to amend the Protocol for the 33rd America’s Cup and design a new class of ship, a process that will continue in 2009 with more meetings planned and the publication of the new class of Boat scheduled for late January.
The schedule for the 33rd America’s Cup includes two pre-regattas in Valencia in 2009, pending final agreement with the city: the first in July and the second in October, in addition to the annual regatta of the Spanish Sailing Club Nautico in November, followed by the America’s Cup in 2010.
